What the digital EU power of attorney changes for company teams, advisers, notaries, banks and identity providers.

The work differs by role. Companies maintain accurate records and grant authority; advisers determine legal scope; notaries and registers perform national functions; relying parties decide whether to accept an action; identity providers carry and validate evidence.

The common control

Every role needs to keep three questions separate:

  1. Who is the actor?
  2. What company or person do they represent?
  3. Does the current authority cover this exact action?

The power-of-attorney acceptance rule reaches only the entitlement specified in the document [Directive (EU) 2025/25, Art. 16c(2)]. The relying party remains responsible for authenticating and validating the presentation [Regulation (EU) 2024/1183 (eIDAS 2), Art. 5b(9)].
